Terms of Service

1. Agreement

By creating an account or using KlydeLabs ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Your Content and Rights

You represent and warrant that you own — or have obtained all necessary rights, licenses, consents, and permissions for — every video, audio file, image, transcript, or other material you upload to the Service ("User Content").

You are solely responsible for your User Content, including its legality, accuracy, and any consequences of publishing the outputs generated from it. KlydeLabs does not review User Content before processing.

You retain all ownership of your User Content and the Generated Content produced from it. By uploading, you grant KlydeLabs a limited, worldwide, non-exclusive, royalty-free license to store, transcode, transcribe, analyze, and otherwise process your User Content solely to operate and provide the Service to you (for example, to generate clips, transcripts, subtitles, and summaries). We do not claim ownership of your content, we do not sell it, and we do not use your content or transcripts to train AI models. This license ends when you delete the content or close your account, except for copies retained transiently in backups or as required by law.

3. AI-Generated Outputs

KlydeLabs uses third-party artificial intelligence, transcription, storage, and payment processors to produce clips, subtitles, summaries, titles, descriptions, chapters, scoring, and other suggestions ("Generated Content").

Generated Content may contain errors, inaccuracies, hallucinations, offensive language, mistranscriptions, biased ratings, or other defects. You are responsible for reviewing and editing Generated Content before publishing it anywhere. You use Generated Content at your own risk.

KlydeLabs makes no guarantee that Generated Content — or any clips, scores, or recommendations produced by the Service — will result in views, audience growth, engagement, monetization, revenue, or any other outcome.

4. Plans, Subscriptions & Billing

KlydeLabs offers the following plans:

  • Free — $0/month: 1 hour of video / month (up to 1 hour per video), with a KlydeLabs watermark on generated clips.
  • Starter — $9.99/month: 4 hours of video / month, up to 3 hours per video, no watermark.
  • Pro — $19.99/month: 8 hours of video / month, up to 3 hours per video, no watermark.
  • Max — $49.99/month: 25 hours of video / month, up to 3 hours per video, no watermark.

Paid plans are billed in advance and renew automatically each month via Stripe until you cancel. By starting a paid plan, you authorize KlydeLabs and Stripe to charge your payment method for each billing period. Plan limits (monthly video hours, per-video length cap, watermark) apply to your active plan only.

Upgrades take effect immediately; you are charged the prorated difference for the remainder of the current period, and your renewal date does not change. Downgrades take effect at the end of your current billing period, so you keep your current tier until then; you can cancel a scheduled downgrade from your Billing page any time before it takes effect. You may cancel your plan at any time from the Billing page; cancellation takes effect at period end and you keep access until then, after which your account returns to Free.

Except where required by law, fees are non-refundable, including for partial billing periods. KlydeLabs may change pricing or plan features with reasonable notice.

Fair use. Each plan includes a monthly video-hours allowance for normal, individual creator use — 1 hour/month on Free, 4 hours/month on Starter, 8 hours/month on Pro, and 25 hours/month on Max (measured as the total duration of the videos you submit per billing period). We monitor processing against your plan's allowance. We will not change your experience for occasionally approaching the allowance, and today we do not automatically throttle accounts. However, for usage that materially or repeatedly exceeds your plan's allowance, we reserve the right to contact you, throttle or temporarily limit processing, or require an upgrade to a plan that fits your usage. This protects Service speed and availability for all creators.

5. Prohibited Content and Conduct

You may not upload, generate, distribute, or publish via the Service:

  • Content that is illegal in the jurisdiction it originates from or is consumed in;
  • Content that infringes copyright, trademark, publicity, privacy, or other rights;
  • Hateful, harassing, defamatory, threatening, or abusive content;
  • Sexually explicit content, content involving minors, or non-consensual intimate imagery;
  • Content depicting graphic violence, self-harm, or terrorism;
  • Malware, phishing material, or content designed to compromise systems;
  • Personal data of others uploaded without lawful basis or consent;
  • Attempts to reverse-engineer the Service, evade plan limits, or abuse rate limits.

6. Third-Party Processors

To deliver the Service, KlydeLabs transmits limited data to third parties: OpenAI (audio transcription and AI text generation for clips, summaries, titles, and related outputs) and Stripe (payment and subscription processing). We also use infrastructure and email-delivery providers to host the Service, Cloudflare Turnstile for bot/abuse protection on the sign-in, sign-up, and upload forms, and an email-delivery provider to send account notices. With your consent, we also use Google Analytics for aggregate, privacy-respecting usage analytics (you can decline analytics cookies — see our Privacy Policy). Some processing — including word-level subtitle alignment and speaker analysis — runs on our own servers and is not sent to third parties. Each processor applies its own terms and privacy policy to data it receives. See our Privacy Policy for details.

7. Disclaimers and No Warranty

THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLYDELABS AND ITS OPERATORS, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY GENERATED CONTENT. KLYDELABS'S AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO KLYDELABS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Account Termination

KlydeLabs may suspend or terminate your account at any time for violation of these Terms, suspected fraud, security incidents, or non-payment. You may delete your account and all associated data at any time from the Settings page (or by contacting us); deleting your account cancels any active subscription and is permanent.

10. Communications and Marketing Emails

When you create a KlydeLabs account, you agree that we may contact you by email. This includes service and transactional messages (such as account, security, billing, and job-completion notices) that are necessary to operate your account, and product updates and marketing emails (such as new features, tips, and offers).

You can opt out of product and marketing emails at any time — either from the email-preferences controls on your Settings page, or by using the unsubscribe link included in every such email. Opting out does not affect service and transactional messages, which we may continue to send while your account is active because they are necessary to provide the Service.

11. Changes to the Service or Terms

KlydeLabs may modify, suspend, or discontinue features at any time. We may update these Terms; material changes will be notified through the Service. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction and venue there. Nothing in this section limits any non-waivable rights you may have under the consumer-protection laws of your place of residence.
